Terms of Service

1. Acceptance of Terms

These Terms of Service form a binding agreement between you and FujiWash LLC ("FujiWash," "we," "us," or "our") governing your use of the FujiWash website and booking platform. By using FujiWash, you represent that you have read, understood, and agree to these terms.

2. Description of Service

FujiWash operates as a mobile car detailing marketplace and dispatch platform. We connect customers seeking vehicle detailing with independent, vetted local detailing contractors. FujiWash facilitates online booking, scheduling, payment processing, and communication between you and the contractor. FujiWash does not itself perform detailing services and is not a detailing company. The actual service is performed by third-party contractors who are not employees, agents, or partners of FujiWash.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use FujiWash. By booking, you represent that all information you provide—including your vehicle make, model, condition, service address, and contact details—is accurate, complete, and truthful. You must have legal permission to authorize service at the location you provide.

4. Booking, Scheduling, and Cancellation Policy

Appointments are booked through the FujiWash platform. Once confirmed, you will receive a booking confirmation by email or text. You may reschedule or cancel through your booking confirmation or by contacting us directly.

Cancellations made at least 24 hours before the scheduled appointment are eligible for a full refund or reschedule. Cancellations made after that window, or missed appointments, may be subject to a cancellation fee of up to 30% of total payment. FujiWash reserves the right to reschedule appointments due to severe weather, unsafe working conditions, or contractor unavailability, in which case you will be notified as soon as possible.

5. Payment Terms

All payments are processed securely through our third-party payment processor. By booking, you authorize us to charge the payment method you provide for the agreed-upon service price, including any applicable taxes or fees. Pricing is subject to change based on vehicle size, condition, add-ons, or location, and any adjustments will be disclosed before you confirm your booking.

If you are not present at the scheduled appointment time, or if the contractor cannot access the vehicle due to reasons within your control, you may be charged a no-show fee of 30% of total payment.

6. Independent Contractor Disclaimer

The detailing professionals who perform services booked through FujiWash are independent contractors, not employees or agents of FujiWash. Each contractor operates their own business and is solely responsible for the quality, safety, technique, and performance of the detailing service. Contractors are responsible for their own insurance, licensing, tools, and compliance with applicable laws and regulations.

FujiWash vets contractors before they join the platform and provides tools to facilitate communication and dispute resolution, but FujiWash does not guarantee any contractor's work and is not liable for the acts, omissions, or workmanship of any independent contractor. Any claim related to service quality or damage must primarily be directed to the contractor who performed the service, and FujiWash will reasonably assist in connecting you with that contractor.

7. Customer Responsibilities

You agree to: (a) provide the contractor with safe access to the vehicle and a suitable work area; (b) disclose any pre-existing damage, scratches, leaks, or unusual conditions before service begins; (c) remove all personal belongings, valuables, and fragile items from the vehicle prior to the appointment; (d) keep pets and children away from the work area during service; and (e) communicate clearly with the contractor regarding any special requests or concerns.

8. Limitation of Liability and Disclaimer of Warranties

FujiWash provides the platform on an "as is" and "as available" basis. To the fullest extent permitted by law, FujiWash disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event will FujiWash be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or loss of use, arising out of or relating to these terms or your use of the platform. FujiWash's total liability for any claim relating to a service booked through the platform will not exceed the amount you paid for that specific service.

9. Indemnification

You agree to indemnify, defend, and hold harmless FujiWash LLC, its owners, affiliates, officers, and employees from any claims, damages, losses, liabilities, or expenses arising out of (a) your use of FujiWash; (b) your breach of these terms; (c) any inaccurate information you provide; (d) the actions or omissions of any contractor you book through the platform; or (e) your violation of any third-party right.

10. Dispute Resolution

These Terms are governed by the laws of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or your use of FujiWash will be resolved through binding arbitration in accordance with the rules of a recognized arbitration association, except that either party may seek relief in small claims court or seek injunctive relief in a court of competent jurisdiction. You agree that any arbitration will be conducted on an individual basis and waive any right to participate in a class action or class-wide arbitration.

11. Phone Communications

Calls to FujiWash's customer line may be recorded and/or transcribed by our automated phone system for quality assurance, training, and service improvement. This recording will be disclosed at the start of any recorded call. If you do not wish to be recorded, you may end the call or request an unrecorded communication method.

12. SMS and Email Communications

By providing your phone number and email address, you consent to receive service-related communications from FujiWash, including booking confirmations, appointment reminders, dispatch updates, and follow-up messages. You may also receive marketing messages from us from time to time. You can unsubscribe from marketing emails at any time by clicking the unsubscribe link, and you can stop marketing text messages by replying STOP. Standard messaging and data rates may apply.

13. Intellectual Property

The FujiWash name, logo, trademarks, website content, and brand materials are owned by FujiWash LLC and are protected by applicable intellectual property laws. You may not use our trademarks or reproduce our content without our prior written permission.

14. Termination of Access

We reserve the right to suspend or terminate your access to FujiWash at any time, with or without notice, for any reason, including violation of these Terms, fraudulent activity, or conduct that we believe may harm our platform, contractors, or other users.

15. Modifications to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of FujiWash after any changes means you accept the updated Terms. We encourage you to review this page periodically.

16. Severability, Entire Agreement, and Contact Information

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FujiWash regarding your use of the platform.
